Safeguarding

The Artist agrees to follow guidelines and procedures as required by the HMM Arts Ltd. and partner Safeguarding Policies. The Artist understands that the agreement with HMM Arts Ltd. is subject to a current enhanced level Disclosure Barring Service (DBS) disclosure or evidencing a current DBS via the Update Service and providing two acceptable references, if requested by HMM Arts Ltd. Your work cannot begin until a valid DBS enhanced disclosure certificate has been seen.

Safeguarding training will be offered by HMM Arts Ltd. Or other verified training providers such as SSCP (Shropshire Safeguarding Community Partnership) and the Artist must commit to taking part in this training. An understanding of and commitment to following the safeguarding requirements of HMM Arts Ltd. is essential and training must be kept up to date.

The Artist must inform HMM Arts Ltd. at their earliest opportunity and as a matter of urgency if any safeguarding issues arise.

 

Insurance

The Artist must provide adequate public liability insurance. If the Artist uses a motor vehicle, he/she must ensure that the vehicle complies with current legislation relating to such a vehicle and carry the relevant insurance for it to be used.

Mutuality of Obligation

HMM Arts Ltd. is not obligated to provide work for the Artist.

Taxation

The Artist is not an employee of HMM Arts Ltd. and is therefore responsible for paying all tax arising on the fees or other payments made under this agreement and for the payment of National Insurance and other similar payments.

Monitoring and Evaluation

Monitoring and evaluation will be facilitated by HMM Arts Ltd. and full co-operation in this process is required to ensure appropriate qualitative and quantitative monitoring and evaluation of the activity. This data must be presented to HMM Arts Ltd. no more than 14 days after your workshop or project end.

The Artist is required to ensure accurate monitoring statistics are fed back to HMM Arts Ltd. via the online system.

Management of the contract will be provided by HMM Arts Ltd.

Failure to co-operate will result in termination of contract.

Risk Assessment

The Artist must ensure that any Risk Assessment requirements requested by HMM Arts Ltd. are met.

Payments will be made on production of the appropriate evaluation and monitoring information and risk assessment required by HMM Arts Ltd.

Payment of Fee

Invoices should be received by HMM Arts Ltd. via the online system no later than 14 days after completion of contracted work.

Individual Artist fees are variable depending on type of activity being delivered, individual role in activity (i.e., leader, session worker, or shadowing artist) and time duration of delivery.

Cancellation of Sessions

Should sessions be cancelled with less than 14 days’ notice by HMM Arts Ltd. or the venue provider, and unable to be re-arranged at a mutually convenient time, full payment will be made to the Artist for that session.

Should the Artist be unable to attend a session, the session should be re-arranged at a mutually convenient time and no payment will be made to the Artist for the cancelled session.

Should any of the above occur the Artist should contact The Hive and, where relevant, the client as soon as possible.

Please note this is a contract for services and therefore there is no entitlement to sick pay or holiday pay.

Confidentiality

All Artists’ personal details are stored in-line with HMM Arts Ltd. GDPR Policy and will not be shared with outside organisations.

Termination

This Agreement may be terminated at any time by either party upon the provision of 28 days’ notice to the other party.

If the Artist fails to fulfil the terms of the contract or acts in any way to bring HMM Arts Ltd. into disrepute the agreement will be terminated forthwith without notice

Shadowing Artists

From time to time, the Artist may be asked to provide shadowing/observation opportunities for trainee Artists. The precise requirements will be discussed and agreed with the Artist in advance, as and where appropriate.
